In this post, the author seeks to critically analyse the legal framework for mining in India. In doing so, the author proposes a change that may be made in the law for enhancing its ability to ensure sustainability in the sector.
This essay was awarded the 1st Position at the IDIA-TCLF National Essay Writing Competition, 2021, on the theme, “Intersection of Environment and the Law: Analyzing the Evolving Legal Regime”. The essay focuses upon the challenges presented by contemporary environmental law issues in the application of the law of state responsibility under international law.

In this essay, the authors have attempted to highlight the various shortcomings in the EIA and Public Participation regime in India, particularly focusing upon the Draft EIA Notification, 2020.
